I, LAWRENCE THEODORE MONTGOMERY, a legal resident of the State of Idaho
, County of Canyon, of legal age, and of sound and disposing mind and m
emory, and not acting under duress, menace, fraud or undue influence of a
y person whomsoever, do make, publish and declare this to be my LAST W
ILL AND TESTAMENT in the following manner.
ARTICLE I
I hereby cancel, annul and revoke any and all Wills, Codicils, or Testa
ments made by me at any time heretofore.
ARTICLE II
I hereby declare that I am married and that my spouse's name is BLANCHE A
GNES MONTGOMERY. I further declare that I present have eleven children w
hose names are FLORENCE MARIE, IRENE DOROTHY, MYRTLE CHARLOTTE, MORRIS W
ALTER, MARVIN LAWRENCE, WILLIAM CLARENCE, DEANNA ESTHER, ALWIN EUGENE, T
HEODORE RICHAD, LINDA LEE, and LAURA CHRISTINE.
ARTICLE III
I direct that my Executor, hereafter named and acting, pay all of my ju
st debts as soon as possible after my death.
ARTICLE IV
To my son WILLIAM I give, evise and bequeath my shop building and all m
y shop power tools, and hand tools. All of the rest, residue and remai
der of my estate, personal, real, or mixed, including any property ove
which I may have a power of appointment, of whatever kind and whereve
located at the time of my death, I give, devise and bequeath to my sp
ouse, above-named, if she survives me for a period of at least thirty (
30) days, believing that she will make ample provisions for my children w
ho survive me.
ARTICLE V
In the even that all of the persons who would receive property under Ar
ticle IV of this WILL fail to survive me, then, I give, devise and bequ
eath the rest, residue and remainder of my estate, personal, real, or m
ixed, including any property over which I may have a power of appointme
t, of whatever kind and wherever located at the time of my death in th
e following manner: Seventy-five (75) percent to be divided equally sh
are and share alike to my surviving children or to their issue by right o
f representation and twenty-five (25) percent to The Good Shepherd Fund
, a non-profit organization, 801 High Street, Santa Cruz, California 95
060 to establish the LAWRENCE AND BLANCHE MONTGOMERY ENDOWMENT. I have m
y daughter, LAURA, in mind but have excluded her as beneficiary of my e
state.

ARTICLE VI
In the event that my spouse predeceases me or does die simultaneously w
ith me, then I hereby nominate and appoint as guardian of the person of m
y daughter, LAURA, the Executive Director of The Good Shepherd Fund, 80
1 High Street, Santa Cruz, California 95060 or his successor, to serve w
ithout bond. In this connection it is my desire that my said daughter, L
AURA, shall live in a care center providing a sheltered Christian envir
onment for her remaining lifetime.
ARTICLE VII
I hereby nominate and appoint my son, William, as Executor of this, my L
AST WILL AND TESTAMENT, and direct that he be allowed to serve without b
ond or surety and without accounting in so far as permitted by law. In t
he event that he fails or ceases to qualify, I nominate and appoint my d
aughter, FLORENCE, as Executrix of this, my LAST WILL AND TESTAMENT, an
d direct that she be allowed to serve without bond or surety and withou
t accounting in so far as permitted by law. I hereby authorize and emp
ower my Executor, if and whenever in the settlement of my estate and ex
ecution of his office with respect thereto, as he shall deem such actio
necessary or proper, to sell, exchange, convey, transfer, mortgage, a
ssign, pledge, invest or reinvest the whole or any part of my estate an
d to execute good and sufficient deeds and other instruments pursuant t
hereto and in respect thereof, without the necessity of advertisement a
d without the necessity of obtaining any court order.
